Terms of Service — English
1. Who operates FredSpeak
Provider and data controller: Decaseo di Magni Federico, a sole proprietorship owned by Federico Magni.
Business address: Via Geromina 10, 24047 Treviglio (BG), Italy.
VAT number: IT03808600161.
Email for support, withdrawal and privacy: info@fredspeak.com. You can also use our contact page.
2. The service and eligibility
FredSpeak is an online American English learning service with short lessons, quizzes and optional microphone exercises. Guest access has limits; Premium provides the features described on the pricing and checkout pages. It is a subscription service, not a lifetime software license. You must be at least 18 to create a paid account. These terms apply to personal learning use. A consumer is a person acting outside their business or profession.
3. Your account and learning progress
Provide accurate account and billing details, protect your password and contact us promptly about suspected unauthorized use. Each subscription is for one user; do not resell or share access commercially. Guest progress is stored in that browser and can be lost when storage is cleared. Guest progress is not imported into Premium. New Premium progress is saved to your account. Subscription cancellation and account deletion are separate requests. An expired subscription does not itself erase saved results.
4. Technical requirements
You need an internet connection, an up-to-date compatible browser and JavaScript. Microphone exercises require a working microphone, browser permission and a secure connection. Recording and playback support can vary by browser and device. You can use the textual learning activities without recording your voice. Review the features and compatibility restrictions shown before payment. Tell us if a technical issue prevents the purchased service from working.
5. Orders, prices and payment
The checkout identifies the plan, billing period, recurring amount, currency, applicable taxes and total before you place an order with an obligation to pay. Your order is accepted when successful payment and activation are confirmed. A confirmation must be provided on a durable medium, such as email, with the applicable terms and withdrawal information. You can review and correct your details before submitting. Keep the confirmation.
We accept Stripe and PayPal, as offered at checkout. Their terms apply to payment processing; FredSpeak remains responsible for its service and your statutory rights. Your selected payment method may be charged automatically for authorized renewals. Your payment provider or bank may apply separately disclosed conversion or other charges. We do not request full card details by email. Billing and payment identifiers are covered by our Privacy Policy.
6. Renewals and cancellation
A recurring plan renews for the billing period shown at checkout until canceled. Stop future renewal through Manage Premium, or contact us if that control is unavailable. Paid access normally continues through the paid period. Canceling renewal does not automatically refund a previous payment. Withdrawal and conformity rights remain available under our Refund Policy. A failed payment may lead to temporary loss of Premium access after notice, without arbitrary penalties.
Where Italian Consumer Code Article 65-bis applies, the provider must send the prescribed written reminder at least 30 days before the contractual cancellation deadline through the agreed channel. If omitted, the consumer retains the statutory right to withdraw without costs until the next expiry. Renewal prices and material changes must be communicated in advance as legally required; these terms do not authorize undisclosed price increases.
7. Consumer withdrawal and refunds
Consumers normally have 14 days from conclusion of a distance service contract to withdraw without a reason. Starting lessons, logging in or recording does not automatically remove that right for an ongoing subscription. An express request for early performance can result in a proportionate charge only when the statutory conditions are met. See the Refund Policy, which forms part of these terms, for the procedure, exceptions, timing and optional form.
8. Learning content and automated feedback
All FredSpeak lesson content—including theory, examples, quiz questions, answer keys and explanations—is created using artificial intelligence (AI) models. Pronunciation analysis and the resulting feedback also use AI models and automated processing.
By using FredSpeak, you acknowledge that AI-generated content and automated assessments can contain errors, omissions or inaccuracies, including in theory, questions, answers, explanations, pronunciation recognition and feedback. Noise, microphone quality and accent can also affect the results. We aim to provide accurate, useful American English instruction, but we do not guarantee that every item or assessment is error-free.
Help us improve: if you notice an error or an unclear explanation, please contact us or email info@fredspeak.com. Include the lesson title, the question or feedback concerned, and a short description. We review reports and make corrections where appropriate.
Scores and feedback are educational estimates, not identity checks, medical assessments or official language certifications. We do not guarantee a particular score, accent or fluency within a fixed time. Acknowledging the limitations of AI does not waive your mandatory consumer rights or excuse a failure to meet legally required conformity.
9. Recordings, privacy and nickname
Microphone use is optional. Record only your own voice and the practice phrase; avoid sensitive information and other people’s voices. Audio is submitted when you request feedback. It is used for the requested pronunciation analysis, not identification or training of the current model. See our Privacy Policy for retention, providers and rights. Premium leaderboard entries show your nickname and verified rubies; choose a nonidentifying nickname. Accepting these terms is not consent to advertising or unrelated data use.
10. Permitted use and intellectual property
You receive personal, nonexclusive access during the applicable access period. FredSpeak and its licensors retain rights in their lessons, software and original media. Do not redistribute the course, harvest accounts, bypass payment or usage limits, upload unlawful material or interfere with security. Statutory exceptions remain unaffected. You retain rights in your recordings and permit only transmission and processing needed for the requested service, without a general commercial reuse license.
11. Availability, updates and changes
We supply updates needed for conformity, including security updates, for the legally required period. Maintenance or incidents may interrupt access; significant known interruptions will be communicated where practicable. Applicable contractual and statutory remedies remain available.
Changes beyond those needed for conformity require a valid reason, such as security, legal requirements or necessary technical compatibility, no extra cost and clear information. If a change adversely affects access or use beyond a minor degree, advance durable notice must explain the right to terminate free of charge within the statutory 30-day period, unless an unchanged compliant version remains available without extra cost. Paid entitlements cannot be removed arbitrarily. New terms do not retrospectively remove accrued rights.
12.1 Conformity, suspension and liability
Consumers retain mandatory digital-content/service rights under Italian Consumer Code Articles 135-octies and following. For continuous supply, conformity is required throughout the contractual period. Legal remedies include free restoration of conformity and, where the conditions are met, price reduction, termination and refund. A screenshot may help support but is not a mandatory condition for legal rights.
Serious abuse or security risks can justify proportionate suspension. We explain the reason and allow correction when appropriate unless law or urgent security needs prevent this. Suspension does not automatically forfeit every payment. No exclusion applies to intentional misconduct, gross negligence, protected personal injury, unlawful personal-data processing or other liability that cannot legally be excluded. There is no general waiver of claims or consumer remedies.
Liability for downtime or inaccessible service. We do not guarantee uninterrupted access. For users acting for business or professional purposes, and only to the extent permitted by applicable law, our aggregate liability for damages arising from service downtime or inaccessibility is limited to the subscription fees actually paid and attributable to the calendar month in which the interruption first occurred. For an annual subscription, the monthly amount is one-twelfth of the annual subscription fee actually paid; it is not zero merely because the annual payment was made in an earlier month.
This contractual cap does not apply to consumers, intentional misconduct, gross negligence, personal injury, unlawful personal-data processing or any other liability that cannot lawfully be limited. It does not reduce any mandatory refund, price reduction, termination right or other statutory remedy, including rights concerning a prepaid annual subscription.
12.2 AI Generated Content
By accessing or using any page of this website or application, you agree to these terms. All lessons and audio recordings are generated using advanced artificial intelligence.
Although we make every effort to provide the highest possible quality, lessons and audio recordings may contain errors or inaccuracies. Please report any issues you find so we can correct them as soon as reasonably possible.
FredSpeak is not a school or an accredited educational institution and does not award qualifications, certifications, or formal academic recognition. It provides structured educational and entertainment content designed to help users practice and improve their English across a wide range of topics.
13. Complaints, law and disputes
Contact us with the account, purchase reference and issue; never send passwords or full payment credentials. Italian law applies without depriving consumers of applicable mandatory protection in their habitual-residence country. For disputes with users who are not consumers, the Tribunale di Bergamo, Italy, has exclusive territorial jurisdiction, subject to mandatory rules on jurisdiction and subject-matter or monetary competence. For consumers, the courts designated by applicable mandatory consumer-protection rules remain competent; the Bergamo clause does not override those rules. Competent alternative dispute resolution may be used where available; we will give required information about any obligation or commitment to participate. No exclusive mandatory arbitration is imposed. The former EU ODR platform is closed. If a clause is invalid, lawful remaining terms continue; mandatory law prevails. Both language versions describe the same service and rights; discrepancies must be interpreted consistently with mandatory law and consumer protection.
